DRAFT — needs Saudi lawyer review. Not legal advice and not yet in force. Items in [square brackets] are decisions or facts still to be filled in by CLSTRA. The commerce model (fees, payments, delivery, buyer protection, refunds) is not decided, so these terms make no promise about it.
Terms of Service
Last updated: [date]. By creating an account or using the CLSTRA app you agree to these terms.
1. What CLSTRA is
CLSTRA is a platform where people in Saudi Arabia list second-hand items of any kind, post «Wants» for things they are looking for, make offers, reserve pieces and chat. CLSTRA is the venue. Each sale is between the seller and the buyer. CLSTRA is not the seller or buyer of any piece. [Lawyer: confirm the platform's role and liability position under Saudi e-commerce rules.]
2. Your account
- You must be [18]+ and able to enter a contract. One person, one account.
- You sign in with your email and a one-time code. Keep your email account secure; you are responsible for activity on your account.
- Your handle and name must not impersonate someone else or the official CLSTRA account.
- You can delete your account in the app at any time (You → Edit profile → Delete account). What stays after deletion is described in the Privacy Policy.
3. Listing and Wants
- List only items you own and may sell. Use your own photos. Describe the item honestly: its condition, and any flaws, with a photo of the flaws.
- No illegal, stolen, counterfeit, or prohibited items under Saudi law, and nothing unsafe or offensive. [Lawyer/Rakan: add the list of prohibited categories, e.g. weapons, alcohol, pork, adult items, medicines, animals, fake brands.]
- A Want is a request. Answering it with a piece is an offer, not an obligation for the buyer.
- You are responsible for what you post. You give CLSTRA permission to store and show your content in the app so the service works. You keep ownership of it.
4. Offers, reservations and deals
- An accepted offer or a reservation («حجز») is an agreement between the two people to go ahead. It holds the piece for the buyer inside the app. Either side may cancel, which releases the piece. [Rakan: reservation rules (timer, cancellation, “mark sold”) are product decisions still open.]
- Do what you said you would. Do not reserve pieces you do not intend to buy, and do not sell a piece that is reserved to someone else.
- Payment, handover and delivery: [Not decided. Do not promise anything here until the commerce model is approved. Until then, state plainly that CLSTRA does not process payments, hold money, deliver items, or guarantee a deal, if that remains true.]
- Inspect before you pay. Be careful with anyone who asks you to move the deal elsewhere or to pay in advance. CLSTRA staff will never ask for your code or password.
5. Behaviour
Do not harass, threaten, deceive or spam anyone. Do not use the app to commit fraud, to collect other people's data, to avoid a block, or to break the law. You can report a piece, a message or a person, and block someone, from inside the app.
6. What we may do
We may remove content, hide pieces, limit features, or suspend or close accounts that break these terms or the law, or that put others at risk. We will say why where we can. [Lawyer: confirm notice and appeal wording.] We may change or stop parts of the service, especially during the private beta.
7. Private beta
CLSTRA is in a private beta with a small group. It may be unavailable, change, or lose data. Please report problems to [support email].
8. No guarantees, limits on liability
The service is provided “as is”. We do not guarantee that listings are accurate or that any person will behave as promised. To the extent the law allows, CLSTRA is not liable for what users post or do, or for losses from deals between users. Nothing here limits rights you have by law that cannot be limited. [Lawyer: confirm the exact limitation language allowed in the Kingdom.]
9. Privacy
How we handle personal data is in the Privacy Policy.
10. Law and disputes
These terms are governed by the laws of the Kingdom of Saudi Arabia. [Lawyer: courts/venue, and consumer-protection or arbitration wording.]
11. Changes and contact
We may update these terms; the date above will change and important changes will be shown in the app. Questions: [support email]. [Legal entity name and address].
